DOUGLAS Shire Councillors will vote on a recommended Negotiated Decision Notice be issued to Paws and Claws for the upgrading of the Preliminary Approval to a Development Permit (subject to conditions) at Council’s Thursday meeting in Council Chambers.

A negotiated decision cannot be given after the applicant’s appeal period has ended. If the assessment manager agrees to the change representations they must issue a negotiated decision notice. Only one negotiated decision notice can be given.

This is in response to Council voting 3-1 in July to grant preliminary approval for an industrial building to be turned into an animal keeping facility at 6-8 Teamsters Close, Craiglie.

Council’s key contention – and the reason why the application was not approved – focused on a more thorough acoustic report to ensure neighbouring properties would not be disturbed by barking before a final approval could be granted.

The July Council meeting was told that although some acoustic analysis had been done, Council was not completely satisfied concerns raised about noise were adequately addressed. A broader acoustic report was requested.

Paws and Claws has been fighting for a much-needed animal shelter for the past two years which has resulted in many animals being left homeless and uncared for.

Michael Kerr, the president of Paws and Claws, said he was pleased that the required details – requested at the July meeting – had been forwarded to Council and all he could hope for now is a positive outcome.   

At a Special Council Meeting held on 31 July 2018, Council issued a Preliminary Approval for a development application which seeks to repurpose an existing industrial building to house a dog and cat boarding facility which will take place primarily indoors at 6–8 Teamsters Close, Craiglie.

The Preliminary Approval was issued as a consequence of the Acoustic Report lodged in support of the development application assessing potential noise impacts on residential properties external to the industrial estate.

The applicant, on 2 August 2018 suspended the Appeal Period and advised Council that further representations would be submitted which sought to upgrade the Preliminary Approval to a Development Permit.

A revised Acoustic Report has been received in addition to other supporting and explanatory information. The submission of the revised Acoustic Report supplemented by recommended conditions of approval will adequately address and overcome concerns surrounding impacts on adjacent and nearby properties both external and within the estate.
